Wills, Probate & Estates

Many of the problems that arise during probate can be avoided with a well-drafted will. James Hankins will work with you to create a will, trust, power of attorney (both medical and financial), medical directive, designation of guardianship and burial directive. Proper planning can save your family the frustration, inconvenience and expense associated with probating your estate.

There are many reasons why a will may be contested. For instance, the will may not have met the standards required by law; the maker of the will may not have been of sound mind; or, someone may have taken advantage of the maker of the will due to the maker's advanced age or poor health. James will discuss your particular situation to advise you whether the will is valid.

Over the past three decades, James has represented clients in will contests involving:

  • Lack of testamentary capacity due to unsound mind
  • Poorly drafted or ambiguous will
  • Estates in which no will exists
  • Family members excluded due to the undue influence of others
  • James is one of the few attorneys in the Anderson County area who has a proven record of successfully trying will contests to a jury.
